Terms and conditions of sale

Last updated: [À COMPLÉTER : date de mise à jour].

1. Purpose and scope

These general terms and conditions of sale (hereinafter the “Terms”) govern the sale of products on the Tyngda website between the seller identified in Article 2 and any natural person acting for non-professional purposes (hereinafter the “customer”).

They are available on the website at all times. Placing an order implies acceptance of the Terms in force on the date of the order, which the customer acknowledges having read before confirming it. The seller may amend the Terms at any time; the applicable Terms are those in force at the time of the order.

2. Seller identification

  • Company name: [À COMPLÉTER : raison sociale]
  • Address: [À COMPLÉTER : adresse]
  • Registration number: [À COMPLÉTER : numéro d’immatriculation]
  • Email: contact@tyngda.com

Customer service can be reached by email 7 days a week and replies within 24 business hours.

3. Products

The website offers weighted blankets, weighted accessories and bedding accessories. Their essential characteristics (materials, dimensions, weight, care) are presented on each product page.

The products sold are comfort products and not medical devices. They are not intended to diagnose, prevent or treat any disease. If in doubt, or for a child, the customer is invited to seek advice from a healthcare professional. Weighted blankets must never be used for a child under 3 years old or under 15 kg; the child must be able to remove the blanket on their own and an adult must check the chosen weight. The customer follows the instructions for use and care provided.

Offers are valid while stocks last. If a product becomes unavailable after an order has been placed, the customer is informed as soon as possible and may choose another product or obtain a refund of the sums paid.

4. Prices

Prices are shown in euros, including all taxes (VAT included). Delivery is free to the countries served in Europe, the UK, the US, Canada, Australia and New Zealand; no shipping costs are added. The applicable price is the one displayed on the website when the order is confirmed. For deliveries outside the European Union, customs duties and import taxes may apply in accordance with the regulations of the destination country, under the conditions described on the Delivery page.

5. Orders

To place an order, the customer selects the product(s) and their options (model, weight, size, color), adds them to the cart, enters their contact details and delivery address, reads the Terms and then confirms the order with an obligation to pay.

Before final confirmation, the customer can check the details of their order and its total price, and correct any errors. The contract is concluded as soon as the order is confirmed. The seller sends the customer a confirmation email summarizing the order.

The seller may refuse an order in the event of a previous payment dispute or a legitimate suspicion of fraud.

6. Payment

The price is payable when the order is placed. The accepted payment methods are those displayed at the time of payment. Payments are processed by secure payment providers; the seller does not have access to the customer’s full bank details.

The order is only processed once payment has been confirmed. If payment is refused, the order is automatically cancelled.

7. Delivery

Products are delivered to the address provided by the customer when ordering. Orders are prepared and dispatched within 1 to 3 business days from our European warehouse, with tracked home delivery. Transit time depends on the destination country and is communicated to the customer when ordering. Full details are available on the Delivery page.

If no delivery date or period is specified, the seller delivers the product no later than 30 days after the conclusion of the contract. In the event of failure to do so, the customer may terminate the contract under the conditions provided for in Articles L216-6 et seq. of the French Consumer Code.

The risk of loss and damage passes to the customer when the customer, or a third party designated by them, takes physical possession of the product. The customer is invited to check the condition of the parcel on receipt and to report any anomaly as soon as possible to contact@tyngda.com.

8. Right of withdrawal and 30-night trial

8.1 Legal right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to give any reason. Where the order covers several products delivered separately, the period runs from receipt of the last product.

The customer notifies their decision by means of an unequivocal statement sent by email to contact@tyngda.com, or by using the model withdrawal form available on the Returns and refunds page. They return the product no later than 14 days after communicating their decision, following the instructions provided by the seller. Return costs: [À COMPLÉTER : prise en charge des frais de retour].

The seller refunds all sums paid, including the initial delivery costs where applicable, no later than 14 days from the day on which it is informed of the decision to withdraw. It may withhold the refund until it has received the product back or until the customer has supplied proof of having sent it, whichever is earlier. The refund is made using the same means of payment as that used for the order, unless the customer expressly agrees otherwise.

The customer may be held liable for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.

8.2 30-night trial and weight exchange

In addition to the legal right of withdrawal, the seller grants the customer, as a commercial gesture, a 30-night trial from receipt. During this period, the customer may return the blanket and obtain a refund of the price of the item, or request an exchange for a different weight of the same model. The product must be returned clean and complete (cover, insert, accessories), in its original packaging if possible, after first contacting the seller by email. The refund is made no later than 14 days after receipt of the return, using the original means of payment.

This commercial commitment does not deprive the customer of the rights they enjoy under the law.

9. Legal guarantees

Independently of the trial and the right of withdrawal, the customer benefits from the legal guarantee of conformity and the guarantee against hidden defects.

9.1 Legal guarantee of conformity

The consumer has a period of two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears, in accordance with Articles L217-3 et seq. of the French Consumer Code. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

The legal guarantee of conformity entails an obligation to provide all updates necessary to maintain the conformity of the goods, where applicable. It entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them. Goods repaired under the guarantee benefit from a six-month extension of that guarantee. If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if the seller refuses to repair or replace the goods, if the repair or replacement does not take place within thirty days, if it causes major inconvenience to the consumer, or if the lack of conformity persists despite an unsuccessful attempt by the seller to remedy it. The consumer is also entitled to a price reduction or to terminate the contract where the lack of conformity is so serious that it justifies such immediate action. In that case, the consumer is not required to request repair or replacement first. The contract may not be terminated if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered. These rights result from the application of Articles L217-1 to L217-32 of the French Consumer Code. A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L241-5 of the French Consumer Code).

9.2 Guarantee against hidden defects

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.

9.3 How to make a claim

To invoke either of these guarantees, the customer contacts the seller at contact@tyngda.com, stating their order number, a description of the defect and, if possible, photos.

10. Liability

The seller is responsible for the proper performance of the obligations arising from the contract, under the conditions provided for by law. It cannot be held liable in the event of use that does not comply with the instructions, the unforeseeable and insurmountable act of a third party, or force majeure.

The information and advice published on the website, in particular regarding the choice of weight, are provided for guidance only; they do not replace the advice of a healthcare professional. No clause in these Terms limits the rights the customer derives from mandatory legal provisions.

11. Personal data

The personal data collected when an order is placed is processed by the seller to manage orders and customer relations. The terms of processing and the customer’s rights are described in the privacy policy.

12. Customer service, complaints and mediation

For any question or complaint, the customer may contact customer service by email at contact@tyngda.com. The seller endeavors to find an amicable solution to any difficulty.

In accordance with Articles L611-1 et seq. of the French Consumer Code, in the event of a dispute that remains unresolved after a prior written complaint to the seller, the customer may refer the matter free of charge to the following consumer mediator: [À COMPLÉTER : médiateur de la consommation]. Recourse to mediation is optional.

The European online dispute resolution platform, previously available at ec.europa.eu/consumers/odr, was closed on 20 July 2025 and is no longer available. The customer may still refer the matter to the mediator indicated above or to the competent court.

13. Governing law and jurisdiction

These Terms are governed by French law. This choice does not deprive a customer residing in another country of the protection afforded to them by the mandatory provisions of the law of their country of habitual residence.

Failing an amicable solution, the customer may bring proceedings, at their choice, before any of the courts with territorial jurisdiction under the French Code of Civil Procedure, the court of the place where they resided when the contract was concluded, or the competent court under the rules of their country of residence.
